Cashiers' Checks
Paul Stymie had Dick Rufus in a tough spot, and he knew it. Dick had lost most of his regular customers at his boat yard when a storm filled the river channel with sand. Dredging would take a year or more, and meanwhile Dick was being besieged by his creditors. The only asset he could liquidate was his travel lift, and Paul just happened to be in the market for one.
"I'll give you $6,000 up front and $9,000 in 60 days," Paul told Dick. "No credit!" Dick replied. "I need it all right now." So the two men negotiated a price of $12,000, which Dick, who contended the lift was in excellent condition and worth twice that much, insisted must be in the form of a cashier's check. Paul went to his bank, completed the proper form, and got the cashier's check. He delivered the check to Dick and that afternoon had his crew pick up the lift. An hour later Paul got a call from crew chief. "Boss," the man said, "you really got stuck on this thing. The motor and transmission are both shot." Paul immediately phoned that bank. "I want to stop payment on the cashier's check," he told the officer he reached. The seller totally misrepresented what I was buying." "We can't stop payment on a cashier's check," the officer replied. "A cashier's check is the same thing as cash and there is really nothing I can do." "I have almost twice that amount in my bank account. Use that as security and just don't pay the check. I'll cover the check if anything happens."
