The FDCPA and the "Least Sophisticated Consumer"
"Your letters are very confusing," complained Tricia York. "First you say I have 11 days in which to contact you about this debt, and then you say I have 30 days in which to dispute this debt. Then you send a letter that has different dates listed. This one has a bunch of court documents in it--so how can I dispute a debt you already sent to court? And why did you file in a court three counties away? Aren't you supposed to file in my own county or the county where I got into debt?"
"That's a lot of questions," replied Rita Seville, an attorney whose practice was mainly focused on debt collection. "But my question to you is--when do you intend to pay this debt?" "The only thing I intend to do is take you to court," York snapped. "You've broken nearly every part of the Fair Debt Collection Practices Act." "There was nothing wrong with the collection letters I sent to you," Seville countered. "Each one told you about the 30-day period in which you could dispute the debt. The one with the court documents in it stated that I could submit those documents to the court--not that I had." "One sentence does not balance out the nine pages of court documents," York said. "And besides, what about your choice of court?" "Like I said, I could have filed papers. Those were just samples of the type I could file. If I had actually filed papers, I would have chosen the correct court." "Well, all of this violates the FDCPA," York insisted. "You can't threaten actions that are illegal, and you can't take action before my 30 days are up. Your letter said you would file those papers if I didn't contact you in 11 days." "You're reading this all wrong," Seville said. "You should get your facts straight." "No, you're the one who needs to organize her facts," York fumed. "I'll see you in court."
